General Terms of Sale

The purpose of these General Terms and Conditions of Sale (hereinafter the “T&C”) is to describe the terms and conditions of online sales of goods and services offered by Courrèges, which may be adapted or altered by the latter at any time.

Article 1 – Description of Seller

The e-commerce website www.courreges.com (hereinafter the “Website”) is published by the company known as Groupe Courrèges Distribution, with a share capital of 2,001,468.48 euros, registered at the Commercial and Companies Registry of Paris under the number 790 116 768, whose registered office is located at 40, rue François 1er, 75008 Paris (hereinafter referred to as “Courrèges” or as the “Seller”).

Article 2 – Scope of application – Acceptance by the Customer

The T&C specify the terms of ordering, payment, delivery and management of possible returns of the goods ordered by Customers acting as non-professional buyers (hereinafter referred to as the “Customer(s)”) on the Website. Customers are prohibited from any retailing of the new Products delivered by the Seller.

The T&C are accessible at all times on the website: www.courreges.com. They are enforceable against Customers who acknowledges having reviewed and accepted these before placing an order. Consequently, the confirmation of an order implies Customers’ prior and unreserved accession to the T&C.

The Seller reserves the right to alter the T&C at any time. The version applicable to Customers’ purchases will then be the one in force on the Website on the date the order is placed.

Article 3 – Display of Products

Courrèges displays on the Website the Products it offers for sale (hereinafter referred to as the “Products”), as well as the descriptions thereof as presented in product data sheets, to enable Customers to determine the key features of each Product they wish to purchase before ordering these.

The photographs and graphic data displayed on the Website are intended to illustrate the Products offered for sale and are not contractually binding.

Customers are invited to refer to the description of each Product in order to determine the properties and specificities thereof, particularly with regard to the required features and the desired size. The offer in terms of Products is subject to availability. Information regarding Product availability is provided when placing an order. However, an error in the update, whatever its origin, shall not incur Courrèges’ liability. In this regard, Courrèges cannot be held liable for the cancellation of an order for a Product as a result of stocks running out.

Article 4 – Ordering Products

Customers are not required to hold an account to place an order: the Website offers the option of ordering as a guest.

When creating an account, Customers must ensure that the information provided is accurate and complete, and that it is updated where necessary. Customers guarantee Courrèges that this information is duly their personal data and not that of a third party. In the event of fraud or error in the information transmitted, Courrèges shall not be held liable for the consequences, in particular of failure to receive order confirmation/shipping e-mails or of the impossibility to deliver the Products.

Orders placed on the Website are subject to compliance with the policy put in place by Courrèges, which includes successive stages leading to the confirmation of the order. In particular, Customers are afforded the opportunity to check the details of their order and the total price thereof, and if necessary to alter such, before it is confirmed.

Any and all orders confirmed via the website: www.courreges.com entails irrevocable acceptance by Customers, in an unrestricted manner and unreservedly, of the T&C and forms a contract between the Seller and Customers.

Customers will receive confirmation of their order via e-mail. The order will then be final and may no longer be altered. Another e-mail will inform Customers on the day the order is shipped.

Customers will be able to track the progress of their orders:

  • From the shipping email of the order
  • In their personal space on the Website, if they have created an account;
  • By contacting the Website’s Customer Service via the website’s Contact form.

The Seller reserves the right to refuse any and all orders based on legitimate grounds, in particular in the case of:

  • Ordering of an unreasonably large quantity of Products
  • Breach of the T&C
  • Suspected fraud
  • Litigation relating to delinquent payments.

Article 5 – Price and terms of payment

Prices on the Website are shown:

  • in euros for Europe
  • in pounds sterling for the United Kingdom
  • in Swiss francs for Switzerland
  • in US dollars for the United-States, Australia, Canada and Norway
  • in Yen for Japan.

Prices are expressed as inclusive of all taxes (including VAT in eligible countries at the rate applicable on the day of the order), including customs duties and other taxes.

Delivery charges will be covered by Courrèges.

Any bank charges will be borne by the Customer (including in the case of a refund).

The price for the Products purchased will be payable outright, in full on the day the order is placed by the Customer. Courrèges will not be required to proceed with delivery of the Products ordered by the Customer if it has not received payment of the price in full beforehand.

Payments may be made by bank card or via one of the following payment solutions, depending on the country in which the Customer resides: PayPal, Klarna, AliPay, Apple Pay, Google Pay, Wechat Pay.

By using these payment methods to pay for their purchases, Customers acknowledge that they are subject to the terms of use and privacy policies thereof. Any costs associated with these methods of payment will be borne by Customers.

In order to proceed with the payment due, Customers must enter their name and provide their bank card number, the expiry date of the card and, where applicable, the visual cryptogram. Customers’ bank details will be requested for each order. In addition, the payment may be validated by the Customer's bank, via its application or the sending of a security code.

Customers will guarantee Courrèges that they hold the necessary authorisations to use the chosen payment instrument when confirming their order. In the event of refusal by the bank, the order will be automatically refused and Courrèges will then be released of any and all obligation and liability towards Customers.

Courrèges does not process Customers’ payment details, which are sent directly to the Customer's payment service provider, Adyen.

An invoice in electronic format will be attached to the order confirmation email sent to Customers.

Title to the Products will be transferred to Customers only after complete payment of the price by the latter.

Article 6 – Delivery

The Products will be delivered, at no charge, to the address indicated by Customers when placing their order.

Customers are informed that if they place a mixed order for ready-to-wear fashions and fragrances, their Products will be sent in two separate parcels given the safety constraints associated with the transport of hazardous materials.

Deliveries are ensured by our partners: Chronopost, DHL and UPS. Courrèges nevertheless reserves the right to vary this list.

The Seller covenants to deliver the Products promptly. Customers will be provided with an estimated delivery time in the order confirmation email. Failing which, the Products will be delivered within a maximum period of 30 (thirty) days following the date of the order.

In accordance with article L.216-6 of the French Code de la consommation, if the deadline indicated in the order confirmation is exceeded, the Customer may terminate the contract if, after having served formal notice on the professional to deliver the Product(s) within a reasonable additional period, the latter has not complied within this period.

Customers are required to check the condition of the parcel and of the Products at the time of their delivery by the carrier and, if necessary, to make any reservations on the delivery note or the transport receipt and to inform Courrèges thereof, in accordance with the indications set out in article 7 of the T&C.

Article 7 – Returns and refunds

7.1. Exercise of the right of withdrawal

In accordance with article L221-18 of the French Code de la consommation, Customers have the possibility to withdraw, without providing any grounds, without a period of 14 days from the date of receipt of the Product.

Customers can exercise their right of withdrawal by adhering to the policy put into place by Courrèges and subject to strict compliance with the return requirements described in point 7.3 :

  • From the “Generate a return” thumbnail accessible to all from the home page of the Website ; or
  • From your personal space for all Customers with an account.

Returns are handled by Courrèges, which will provide the Customer with a returns label that can be accessed on the Website by following the returns policy.

In accordance with article L.221-28 of the French Code de la consommation, the right of withdrawal cannot be exercised for orders applying to:

  • the supply of goods made to Customer specifications or clearly personalized ;
  • the supply of goods which have been unsealed by the Customer after delivery and which cannot be returned for reasons of hygiene or protection of health.

The Seller moreover reserves the right to refuse to refund Products returned by the Customer if it suspects any unusual, excessive or unreasonable tendency on the part of the Customer with regard to returns (worn clothing, excessive returns, return of products different from those ordered, etc.).

Customers must return the Product(s) to the Seller, without excessive delay and, in any event at the latest fourteen (14) days after having informed Customer Services of their decision to withdraw.

Returns are made via postal service to the address as indicated by the Seller.

No returns will be accepted in-store.

Return charges will be covered by Courrèges.

On receipt and confirmation of the return of the Product(s), Customers will receive an email confirming the refund. The time taken to process refunds varies according to the method of payment used and shall not exceed fourteen (14) days from notification of the Customer's decision to withdraw.

Where Products are returned outside the aforementioned deadline or where Products which were not eligible for a refund are returned, Customers will not be refunded and the Products may be shipped back to them. In any event, Customers will be informed that the Products will remain at their disposal at the warehouse for a period of six (6) months.

7.2. Other grounds for return

  • Empty or damaged parcel or Product missing

Customers are required to check the apparent condition of the parcel and of the Products at the time of delivery by the carrier.

Where the condition of the parcel or its weight appears irregular (parcel unreasonably light, damaged, unsealed, etc.), Courrèges invites Customers to :

  • refuse the parcel or to issue reserves on the delivery note or on the transport receipt; and
  • inform in writing Courrèges’ Customer Service within twenty-four (24) hours from the receipt of their order, enclosing with their request the following items:
    • The sworn statement provided by Customer Services duly completed;
    • A copy of their identity card;
    • A photo of the delivery label clearly visible and legible;
    • Several photos of the parcel received testifying to its external appearance and showing all sides of the parcel in a clear and complete manner;
    • A photo of the open parcel;
    • A photo of the parcel on a scale, with the weight of the parcel clearly visible and legible;
    • Any additional information deemed relevant by the Customer (for example, a video of the unpacking, etc.).

These items will be passed on to the carrier for investigation.

Courrèges undertakes to keep Customers informed promptly of the carrier's response.

If no reservations are raised on delivery or where Customer Services are informed more than forty-eight hours after receipt of the order, Courrèges will not be able to ensure that the Customer's request is taken into account.

  • Non-compliant or damaged Product(s)

In the case where one or more items delivered are defective, Courrèges invites Customers to inform Courrèges’ Customer Services in writing within the shortest time period, enclosing with their request the following items:

  • The sworn statement provided by Customer Services duly completed;
  • A copy of their identity card;
  • A photo of the delivery label clearly visible and legible;
  • Several photos of the parcel received testifying to its external appearance and showing all sides of the parcel in a clear and complete manner;
  • Several photos of the damaged item (including a photo of the item with its label and zoomed-in photos of the relevant details/defects) ;
  • Any additional information deemed relevant by the Customer (for example, a video of the unpacking, etc.).
  • Product(s) not delivered despite notification of receipt

If the parcel is received at a relay point, the Customer is invited to contact the relay point first to obtain further information.

The electronic acknowledgement of receipt signed on receipt, the QR code, the unique code or the handwritten signature affixed by the Customer shall constitute proof of delivery and receipt of the order by the Customer.

Should Customer Services be contacted on these grounds, Customers undertake to provide the following items to enable them to carry out the necessary investigations:

  • The sworn statement provided by Customer Services duly completed;
  • A copy of their identity card;
  • A copy of the complaint lodged within fourteen (14) days of receipt of their order.

Customers are hereby advised by Courrèges against making any misrepresentations.

7.3. Conditions applicable to all return methods

The Product(s) must imperatively have been purchased via the Website.

The Product(s) must be returned in a condition that allows them to be retailed again as brand-new items i.e.:

  • in perfect condition and complete;
  • with its/their original label(s) and the safety rope accompanied by the card bearing the words “Returns will only be accepted if this label has not been detached”;
  • and returned in its/their original packaging.

Fragrances, which are considered hazardous materials and require special transport, cannot be returned.

Details per category of products:

Clothing: returns will be refused if the Product has been worn, washed, damaged, stained or has a bad smell.

  • Underwear/swimsuits: returns may be accepted provided that the Product has been tried on over underwear. For reasons of hygiene, returns will be refused and the item returned to the Customer if the protective plastic has been removed or if the item is stained.

Eyewear/jewellery: Products must imperatively be returned undamaged and unscratched, in their original packaging including their pouch or case.

Footwear: the shoe soles of the Product must be intact, with no marks or micro-scratches. For this reason, we recommend you try the shoes on a rug or carpet-type surface.

Customers must keep proof of return.

Article 8 – Legal guarantees

Courrèges is held to the legal guarantee of conformity mentioned in articles L. 217-3 et seq. of the French Code de la consommation and to the guarantee covering hidden defects, as defined in articles 1641 et seq. of the French Code civil.

Conformity. Where consumers act on the grounds of the legal guarantee of conformity:

- they benefit from a period of two years from delivery of the goods to act;

- they can choose between repair or replacement of the goods, subject to the conditions in terms of cost contemplated by article L. 217-12 of the French Code de la consommation ;

- they are exempted from having to prove the existence of a nonconformity affecting the goods.

Hidden defects. Consumers can decide to implement the guarantee covering hidden defects of the item sold within the meaning of article 1641 of the French Code civil. In this case scenario, they may choose between rescission of the sale or a reduction of the sale price in accordance with article 1644 of the French Code civil.

Article L.217-3: “Sellers shall deliver goods that conform to the contract and to the criteria set out in Article L. 217-5. They are answerable for nonconformities that existed at the time of delivery of the goods within the meaning of article L. 216-1, and which become apparent within a period of two years of delivery. (...) Sellers are also liable, during the same period, for nonconformities resulting from packaging, assembly instructions or installation when the latter was their responsibility under the contract or was carried out under their responsibility, or further still when the incorrect installation, carried out by the consumer as provided for in the contract, is due to shortcomings or errors in the installation instructions supplied by the seller.”

Article L.217-4 : “The goods will conform to the contract if they meet the following criteria, where applicable:1° They correspond to the description, type, quantity and quality, in particular as regards functionality, compatibility, interoperability, or any other characteristic provided for in the contract; 2° They are fit for any special purpose intended by the consumer, brought to the seller's attention no later than at the time of conclusion of the contract and which the latter has accepted; 3° They are delivered with all accessories and installation instructions, to be provided in accordance with the contract; 4° They are updated in accordance with the contract.”

Article L.217-5 : “I.-In addition to the criteria of conformity with the contract, goods are considered to be in conformity if they meet the following criteria: 1° They are is fit for the use normally expected of goods of the same type, taking into account, where applicable, any provisions of European Union law and domestic law as well as all technical standards or, in the absence of such technical standards, specific codes of conduct applicable to the sector concerned; [...]; 4° Where applicable, they are supplied with all accessories, including packaging, and installation instructions that the consumer may legitimately expect; [... 6° They correspond to the quantity, quality and other characteristics, including durability, functionality, compatibility and safety, that the consumer can legitimately expect for goods of the same type, taking into account the nature of the goods as well as public statements made by the seller, by any person upstream in the chain of transactions, or by a person acting on their behalf, including in advertising or on labelling.”

Article 1641 of the French Code civil : “Sellers are held to the guarantee covering the hidden defects affecting the item sold, that make such unsuitable for the use for which it was intended, or which reduce such use to such an extent, that the buyer would not have purchased such, or would only have paid a lesser price, if he or she had been aware thereof.”

Article 1648 subparagraph 1 of the French Code civil: “Actions which result from redhibitory defects must be brought by the purchaser within two years of discovery of the defect.”

Consequences. Within the framework of the legal guarantee of conformity, Courrèges undertakes, at the Customer’s option :

- either to replace the Product by an identical Product subject to stock availability,

- or to refund the price for the Product, within a maximum period of thirty (30) days, if the replacement of a Product should prove impossible.

Within the framework of the legal guarantee covering hidden defects, Courrèges undertakes, at the Customer’s option, after assessing the defect:

- either to refund the full price of the returned Product, within a maximum period of thirty (30) days,

- or to refund part of the price of the Product, within a maximum period of thirty (30) days, if the Customer decides to keep the Product.

Article 9 – Title retention

Courrèges retains full title to the products sold until full payment has been received, including principal, costs, taxes and mandatory contributions.

Article 10 – Liability

Courrèges’ liability may not be incurred for any inconvenience or damage inherent in the use of the Internet, in particular outage of the service, the occurrence of bugs, external intrusion or the presence of computer viruses.

Courrèges’ liability, under the terms of these T&C is strictly limited to monies paid or payable at the time of the transaction giving rise to said liability, whatever the cause or form of the action concerned.

Article 11 – Cases of force majeure

The performance by Courrèges of all or part of its obligations, in particular in terms of shipping, will be suspended in the case of occurrence of a fortuitous event or of a case of force majeure that should hinder or delay performance thereof.

Cases of force majeure are those defined in article 1218 of the French Code civil and traditionally recognised by case law.

Courrèges will inform Customers of the occurrence of a fortuitous case or of a case of force majeure within seven (7) days from the occurrence thereof. Should this suspension continue beyond a period of fifteen (15) days, the Customer will have the option of cancelling the order in progress, and the price of the Products ordered will then be refunded.

Article 12 – Personal data

The rules applicable to the processing of personal data carried out by Courrèges are detailed in the Personal Data Charter.

Article 13 – Applicable law – Litigation

The sale of the Products is governed by French law. Nevertheless, it is specified that consumer Customers residing outside France benefit, where applicable, from the application of the mandatory and protective rules for consumers contemplated by the law of the country in which the Customer resides.

In the event of litigation, Customers may formulate a written claim via the contact form which is available on the Website.

Customers also have the right to take legal action before the courts. All disputes to which this contract may give rise, concerning its validity, interpretation, performance, termination, consequences and any subsequently related matters, will be referred to the competent courts according to standard rule of law.

Article 14 – Intellectual Property

All trademarks, whether figurative or not, illustrations, images, logos and any other content appearing on the Website are and shall remain the exclusive property of Courrèges. Under no circumstances is the Customer or any other person authorised to reproduce, exploit, rebroadcast or use for any purpose whatsoever, even partially, elements of the aforementioned website.

The corporate names, trademarks and distinguishing marks of Products on the website: www.courreges.com are protected under trademark law; the reproduction or representation of all or part of these elements is strictly prohibited.
