General Terms of Sale

The purchase of products from Courrèges via the website www.courreges.com is subject, without restriction, to the present general terms (hereafter referred to as the “General Terms of Sale.”)

The website www.courreges.com is an e-commerce website accessible via the Internet, and available to any internet user (hereafter referred to as "the Customer.") It is operated by Courrèges Distribution, with a capital of € 5,12, listed in the Registre du commerce et des sociétés de Paris under number  790 116 768, whose headquarters are located at 40, rue François Ier, 75008 Paris.

Article 1 – Scope of the terms – Agreement by the customer

The General Terms of Sale govern the conditions of ordering, payment, delivery, and, if applicable, return of products ordered on the website www.courreges.com by customers acting as non-professional purchasers (hereafter referred to as the "Customer.”) The General Terms of Sale are available at all times on the website www.courreges.com. The Customer declares having read and accepted the General Terms of Sale by checking the box "I have read and accepted the General Terms of Sale" prior to completing the online order. These General Terms of Sale may be subject to subsequent modification; the version that applies to the customer’s purchase is the version in force on the website on the day the order is placed.

Article 2 – Product orders

Any order placed on the website www.courreges.com constitutes a contract concluded remotely between the Customer and Courrèges and entails the Customer’s irrevocable acceptance of the General Terms of Sale, without limitation or qualification. To allow the Customer to become familiar with the products before placing an order, the website www.courreges.com presents the characteristics of products available for purchase. In particular, www.courreges.com may provide information about product specifications, uses, dimensions or materials. The selection and purchase of a product is the sole responsibility of the Customer. The photographs and graphics presented on www.courreges.com are intended to illustrate the products available for purchase, and are non-binding. The Customer may refer to the description of each Product in order to know its characteristics, including notably the desired features and size. Products are subject to availability. Information concerning product availability is provided at the time of order. The sale shall not be considered definitive until Courrèges has sent the Customer an email confirmation of the order and has received the payment in full. The Customer may follow the order on the website www.courreges.com and contact the website’s Customer Service via the “Contact Us” section of the website.

Article 3 – Prices and terms of payment

Prices on the website www.courreges.com are indicated in Euros and include all taxes, including the V.A.T. (French value-added tax) applicable on the day of the order. Prices do not include delivery fees; the customer will be informed of the delivery fee when placing the order. Product costs are calculated based on the prices applicable at the time the order is confirmed. The price indicated at the time of the order, and the confirmation of the order by Courrèges, is the final price. Products can be considered available for purchase when they are visible on the website, subject to availability. Courrèges reserves the right to modify prices at any time. When placing an order, the Customer should verify that the product price matches the price on the up-to-date webpage, and not an expired webpage which may have been accessed via a “cache” search. The data provided by the Customer, and which are recorded by www.courreges.com at the time of the order, constitute the proof of the Customer’s transaction with Courrèges. After the Customer has confirmed the order, Courrèges will send you the Customer email confirming that the order has been received. The price of the Products purchased is payable in full on the day of the order, and Courrèges shall not be required to deliver the Products ordered if the price has not first been paid in full. Ownership of the products will be transferred to the Customer only after they have been paid in full. The risk of loss or deterioration of the Products will be transferred to the Customer upon delivery and reception of the Products by the Customer. Delivery charges are listed on www.courreges.com and include all taxes. These charges are to be paid by the Customer, and will be added to the price of the Products. The Customer will be informed of the delivery charges before finalising the order, and will then be asked to pay the total amount of the purchase.

Article 4 – Delivery

The products purchased by the Customer on www.courreges.com will be delivered to the address indicated by the Customer within a maximum of 30 days from the date of the order. If this delivery period is exceeded for reasons not justified by force majeure, the Customer may request the cancellation of the sale as set out in article L. 114-1 of the French Consumer Code and obtain a refund for the amount paid in the sale. Except in exceptional circumstances, or if one or several Products is out of stock, the Products ordered will be shipped together. Deliveries are carried out by an independent delivery company. The Customer is responsible for verifying the condition of Products delivered. In the event of any claims or complaints concerning any nonconformity or obvious defects in the Products delivered, the Customer has 30 days from the date of delivery to send a letter by registered mail to Courrèges – Relation Client, 40, rue François Ier, 75008 Paris, or by email via the “Contact Us” section of the website www.courreges.com, along with all related supporting documents. After this time, if the Customer has not filed a complaint, or has not respected all of the abovementioned formalities, the Products will be considered compliant and free of any obvious defect, and no subsequent complaints will be accepted by Courrèges. Courrèges will replace, promptly and at its own expense, any Product the Customer has duly proven to be noncompliant or defective. If any noncompliant Product is returned following a delivery error, it must be sent back, along with the delivery note, to Courrèges, 40 rue François Ier, 75008 Paris. The Customer will receive a refund for the noncompliant Product within 7 days from the date the product is returned. Delivery and return charges for the noncompliant Product will be paid by Courrèges.

 

- Empty or damaged parcel or Product missing


Customers are required to check the apparent condition of the parcel and of the Products at the time of delivery by the carrier.


Where the condition of the parcel or its weight appears irregular (parcel unreasonably light, damaged, unsealed, etc.), Courrèges invites Customers to :


- refuse the parcel or to issue reserves on the delivery note or on the transport receipt; and
- inform in writing Courrèges’ Customer Service within twenty-four (24) hours from the receipt of their order, enclosing with their request the following items:
   o The sworn statement provided by Customer Services duly completed;
   o A copy of their identity card;
   o A photo of the delivery label clearly visible and legible

   o Several photos of the parcel received tes􀆟fying to its external appearance and showing all sides of the parcel in a clear and complete manner;
   o A photo of the open parcel;
   o A photo of the parcel on a scale, with the weight of the parcel clearly visible and legible;
   o Any addi􀆟onal informa􀆟on deemed relevant by the Customer (for example, a video of the unpacking, etc.).

These items will be passed on to the carrier for investigation.
Courrèges undertakes to keep Customers informed promptly of the carrier's response.
If no reservations are raised on delivery or where Customer Services are informed more than forty-eight hours after receipt of the order, Courrèges will not be able to ensure that the Customer's request is taken into account.

 

 

- Product(s) not delivered despite notification of receipt


If the parcel is received at a relay point, the Customer is invited to contact the relay point first to obtain further information.


The electronic acknowledgement of receipt signed on receipt, the QR code, the unique code or the handwritten signature affixed by the Customer shall constitute proof of delivery and receipt of the order by the Customer.
Should Customer Services be contacted on these grounds, Customers undertake to provide the following items to enable them to carry out the necessary investigations:
     o The sworn statement provided by Customer Services duly completed;
     o A copy of their identity card;
     o A copy of the complaint lodged within fourteen (14) days of receipt of their order.


Customers are hereby advised by Courrèges against making any misrepresentations.

Article 5 – Cancellation period

In accordance with the law, the Customer has a cancellation period of 14 days from the date the Products are delivered to return them to Courrèges for a refund. The Customer may return the Product during the above-mentioned period, the date on the delivery order acting as proof, subject to the following conditions:

  1. The Products must be returned, complete and in their original condition, such that they can be made available for purchase in new condition, along with the return slip included in the shipment and the delivery note. For articles of clothing, the label marked "Returns will only be accepted if this label has not been removed” must be in place. Perfume bottles must not be opened and must be returned with their protective plastic slip.
  2. The Products must be returned to the following address: Courrèges.com, 40, rue François Ier, 75008 Paris. Courrèges recommends that Customers select a tracking option for the parcel in order to avoid any inconvenience in the event of loss or theft of the Products during the return shipment.
  3. The Customer will be fully reimbursed for the amount paid, including delivery charges (unless only a part of the original shipment is being returned), by bank transfer to the account indicated by the Customer, or by cheque within 30 days from the date of cancellation. Return shipping charges will be entirely at the Customer’s expense (unless the Product(s) were noncompliant at the time of delivery.)
  4. If only part of the order is returned, the delivery charges will not be reimbursed by Courrèges given that the Customer received delivery service for unreturned items, and that the delivery charge is fixed regardless of the number of items ordered.
  5. If the Customer returns a Product after expiration of the abovementioned cancellation period, the Customer will not be reimbursed, and will be informed that the Product will remain available at the warehouse for a period of 6 months. The Products may be re-shipped to the Customer at the Customer’s request.

Article 7 – Applicable law – Litigation

The present contract is governed by French law. Any dispute to which this contract could give rise, concerning its validity, interpretation, execution, termination, the consequences and subsequent related issues will be submitted to the Courts having jurisdiction under the conditions of common law.

Article 8 – Intellectual property

All the elements of the website www.courreges.com , operated by Courrèges, are and shall remain the exclusive intellectual property of Courrèges Design. Under no circumstances shall the Customer or any other person be authorized to reproduce, exploit, redistribute, or use in any way, in full or in part, the elements of the above-mentioned website. Company names, brands, and distinctive signs of Products on www.courreges.com are protected under trademark law; the reproduction or representation of any of these elements (in full or in part) is strictly prohibited. Courrèges has been declared to the CNIL under the n° 1558412.

Article 9 – Unique identification numbers (IDU)

Pursuant to Article L.541-10-13 of the French Environment Code, Courrèges has been assigned the following IDU:
